IMPORTANT — READ CAREFULLY
BY CREATING AN ACCOUNT, BROWSING, POSTING, MESSAGING, SUBSCRIBING, OR OTHERWISE USING OUR WEBSITES, APPLICATIONS, OR RELATED SERVICES (COLLECTIVELY, THE "PLATFORM"), YOU ("USER," "YOU," OR "YOUR") AGREE TO THESE TERMS OF SERVICE ("TERMS") WITH LOVED SCENTS LLC ("COMPANY," "WE," "US," OR "OUR"). IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.
These Terms govern general use of the Platform. Additional terms apply to specific features:
- Privacy Policy — how we handle personal information;
- Community Policy — standards for posting and participating in Scent Society;
- Paid membership terms shown at checkout — if you subscribe to a Verified Member or Collector plan.
If there is a conflict between these Terms and a more specific agreement you accept for a feature, the more specific agreement controls for that feature to the extent of the conflict.
1. The Platform
Loved Scents includes:
- Loved Scents (lovedscents.com) — company, brand home, and Amazon-affiliate shop for perfume, candles, makeup, handbags, and shoes;
- Scent Society by Loved Scents — fragrance community (feed, profiles, posts, comments, and related club features).
Loved Scents is not a peer-to-peer marketplace. Members cannot list, sell, or ship products to each other through the Platform. Shop purchases complete on Amazon.
2. Our role
2.1 Technology platform and affiliate shop. We provide a website, community tools, and product pages that link to Amazon. Except where we expressly state otherwise in writing, we are not the retailer, warehouse, distributor, broker, agent, insurer, escrow provider, authenticator, appraiser, or guarantor of products you view on the shop or discuss in Scent Society. Amazon (or another third-party retailer you visit) is the seller of shop items.
2.2 No agency. No partnership, joint venture, employment, or franchise relationship is created between you and the Company by these Terms or your use of the Platform.
2.3 Your responsibility. You are solely responsible for your content, communications, compliance with law, and any purchases you make with third-party retailers.
3. Eligibility — Adults Only
3.1 Adults-only platform. Loved Scents is an adults-only website and service. You must be at least 18 years of age to access, browse, register for, or use any part of the Platform. The Platform is not intended for minors, and use by anyone under 18 is prohibited.
3.2 Age representation. By using the Platform, you represent that you are at least 18 years old and capable of forming a binding contract.
3.3 United States. The Platform is intended primarily for U.S. residents. You may not use the Platform where prohibited by law.
3.4 One account. You may not share credentials, operate multiple accounts to evade enforcement, or impersonate another person.
3.5 Suspended users. You may not use the Platform if your account has been suspended, terminated, or permanently banned.
4. Accounts and security
You agree to provide accurate registration information and keep it current. You are responsible for all activity under your account and for maintaining the confidentiality of your password. Notify us immediately at admin@lovedscents.com if you suspect unauthorized access.
We may require profile completion, email verification, phone verification, or identity verification before enabling certain features.
5. Free society use and paid membership
5.1 Free features. Portions of Scent Society and the shop may be available without a paid subscription, including browsing and certain posting features, as we make them available from time to time.
5.2 Paid membership. If offered, a paid plan unlocks designated society features as described at checkout. Subscription billing, renewal, cancellation, and refunds are governed by the membership terms shown when you subscribe.
5.3 Feature changes. We may add, modify, suspend, or remove Platform features at any time. Collection valuations, note pyramids, scent suggestions, and similar tools are informational only — not appraisals, investment advice, or authentication certificates.
6. Authentic fragrance only
Loved Scents is for authentic fragrance culture. You may not post, promote, solicit, or facilitate counterfeit, replica, "inspired by," or misleading fragrance products.
Members caught promoting fake perfume may be permanently banned from Loved Scents and Scent Society and may be reported to authorities where required.
7. Shop and Amazon affiliate links
7.1 Affiliate shop. The Loved Scents shop is an Amazon Associates catalog. Product pages on lovedscents.com link out to Amazon. Loved Scents LLC may earn a commission on qualifying purchases.
7.2 Amazon is the seller. Price, tax, payment, shipping, returns, and customer service for shop items are handled by Amazon (or another retailer whose site you visit). We do not take shop payments, hold inventory, or ship orders.
7.3 No peer-to-peer sales. The Platform is not a marketplace. You may not list items for sale, request off-platform payment for goods, or use Scent Society as a storefront for peer-to-peer commerce.
7.4 Click records. When you tap Shop on Amazon, we may record that you clicked a product link so we can operate and improve the shop. See our Privacy Policy.
8. Community standards and content
8.1 Adults-only community. Loved Scents is an adults-only (18+) platform. Member content must comply with our Community Policy and must not include revealing, suggestive, harassing, hateful, violent, or illegal material.
8.2 Respect. Do not harass, threaten, dox, spam, or discriminate against other users.
8.3 No abuse of the Platform. You may not scrape, crawl, reverse engineer, circumvent security or rate limits, use unauthorized bots, upload malware, or interfere with Platform operation.
8.4 Community standards. We may monitor, remove, restrict, or disable content and accounts to enforce these Terms and protect the community, with or without notice, to the fullest extent permitted by law.
9. Messaging
Messages may be reviewed to detect contact information, fraud, spam, and policy violations. High-risk messages may be blocked. See our Privacy Policy for details.
10. User content and license
10.1 Your ownership. You retain ownership of content you submit ("User Content"), subject to the license below.
10.2 License to us. By submitting User Content, you grant the Company a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify, adapt, publish, display, distribute, and otherwise use User Content to operate, secure, promote, and improve the Platform — in any media now known or later developed — without compensation to you.
10.3 Your promises. You represent that you have all rights necessary to submit User Content and that it does not violate law, these Terms, or third-party rights.
11. Optional scent tools
Optional tools (such as bottle scanning, note lookup, or scent recommendations) may send content you submit to service providers to generate results. Outputs may be inaccurate or incomplete. Do not rely on those results as the sole basis for authentication, safety, legal compliance, tax reporting, or pricing decisions. See our Privacy Policy.
12. Intellectual property
The Platform, our logos, trade dress, software, and Company content are owned by us or our licensors. These Terms grant no ownership interest. You may not use our trademarks without written permission.
13. Privacy
Our Privacy Policy explains how we collect, use, and protect personal information. By using the Platform, you consent to those practices as updated from time to time.
14. Suspension and termination
We may suspend or terminate your account or access to any part of the Platform immediately if you breach these Terms, related policies, or applicable law, or if we reasonably believe your conduct creates risk to users or the Company. Upon termination, your right to use the Platform ends. Sections that by nature should survive (including disclaimers, limitations, indemnity, and dispute resolution) survive termination.
15. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE COMPANY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, THAT DEFECTS WILL BE CORRECTED, OR THAT PRODUCT PAGES, AMAZON LISTINGS, MESSAGES, VALUATIONS, OR USER CONTENT ARE ACCURATE, COMPLETE, CURRENT, OR RELIABLE.
16. Limitation of liability
16.1 Exclusion. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO THE PLATFORM OR THESE TERMS.
16.2 Cap. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100.00) OR (B) THE TOTAL FEES YOU PAID TO US FOR PLATFORM SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
16.3 Basis of bargain. YOU ACKNOWLEDGE THESE LIMITATIONS ARE A FUNDAMENTAL BASIS OF THE BARGAIN.
17. Indemnification
You shall defend, indemnify, and hold harmless the Company and its owners, officers, directors, employees, contractors, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your User Content; (c) any third-party purchase you make after following a shop link; (d) your breach of these Terms; or (e) your violation of law or third-party rights.
18. Dispute resolution
18.1 Informal resolution. Before filing a claim, contact admin@lovedscents.com and allow thirty (30) days to resolve the dispute informally.
18.2 Arbitration. Except for qualifying small-claims matters and claims for injunctive relief against unauthorized use or intellectual property misuse, any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, or as otherwise required by applicable law. The Federal Arbitration Act governs interpretation and enforcement of this section.
18.3 Class action waiver. YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
18.4 Venue. If arbitration does not apply, you consent to exclusive jurisdiction in state or federal courts located in Nevada, and waive objections to venue and forum non conveniens to the extent permitted by law.
19. Governing law
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your state apply.
20. Changes to these Terms
We may update these Terms by posting a revised version and updating the agreement version date at the top of this page. Material changes may be communicated through the Platform or by email where appropriate. Continued use after the effective date constitutes acceptance, to the extent permitted by law. If you do not agree, stop using the Platform and cancel any paid subscriptions before renewal.
21. Miscellaneous
21.1 Entire agreement. These Terms, together with the Privacy Policy, Community Policy, and any additional agreements you accept for specific features, form the entire agreement regarding general Platform use.
21.2 Severability. If any provision is unenforceable, the remainder stays in effect.
21.3 No waiver. Our failure to enforce a provision is not a waiver.
21.4 Assignment. You may not assign these Terms without our consent. We may assign freely.
22. Patent notice
Certain scent-discovery and recommendation features on the Platform are covered by a pending U.S. patent application for affective cross-category olfactory product recommendation using machine-learned lovability scoring.
